Foundational Law Review: Theory & Praxis (FOLAR) advocates for the open exchange of legal scholarship and the democratization of knowledge. To ensure the widest possible dissemination of research while protecting the intellectual property rights of our contributors, FOLAR operates under the following Copyright and Licensing terms.

I. Copyright Policy

Upon the acceptance of a manuscript for publication, the following copyright arrangement shall enter into force:

  1. Retention of Rights:

Authors retain full copyright ownership of their respective manuscripts. Unlike traditional publishing models that require a total transfer of copyright, FOLAR acknowledges the author as the primary holder of the intellectual property.

  1. Grant of Publication Rights:

The author hereby grants FOLAR the Right of First Publication, allowing the journal to be the first venue to publish the work in print and/or electronic format. This grant is non-exclusive, meaning the author remains free to disseminate the work elsewhere subsequent to its publication in FOLAR, subject to the attribution requirements set forth below.

  1. Subsequent Distribution:

Authors are permitted and encouraged to post their work online (e.g., in institutional repositories, on their personal website, or on academic social networks like SSRN or Academia.edu) prior to and during the submission process, as it can lead to productive exchanges, as well as earlier and greater citation of published work.

II. Licensing Terms (Creative Commons)

To facilitate global academic discourse, all articles published in FOLAR are licensed under the Creative Commons Attribution-ShareAlike 4.0 International License (CC BY-SA 4.0).

Under the terms of this license, third parties (readers, scholars, and institutions) are free to:

  • Share: Copy and redistribute the material in any medium or format.
  • Adapt: Remix, transform, and build upon the material for any purpose, even commercially.

These freedoms are contingent upon the following strict conditions:

  1. Attribution: You must give appropriate credit, provide a link to the license, and indicate if changes were made. You may do so in any reasonable manner, but not in any way that suggests the licensor endorses you or your use.
  2. ShareAlike: If you remix, transform, or build upon the material, you must distribute your contributions under the same license as the original.
  3. Citation Requirement: Any reproduction or republication of the work, in whole or in part, must clearly cite The Foundational Law Review: Theory & Praxis (FOLAR) as the original source of publication, including the DOI (Digital Object Identifier) link.

III. Author Warranties and Indemnification

By submitting a manuscript to FOLAR, the author warrants and represents that:

  1. Originality: The manuscript is an original work and does not infringe upon any existing copyright, trademark, or other intellectual property rights of any third party.
  2. No Prior Publication: The manuscript has not been previously published in whole or in part, nor is it currently under consideration for publication elsewhere.
  3. Indemnification: The author agrees to indemnify and hold harmless FOLAR, its editorial board, and its publisher against any claims, liabilities, or damages arising from a breach of these warranties, including but not limited to claims of copyright infringement, libel, or invasion of privacy.

IV. Privacy Statement

The names and email addresses entered in this journal site will be used exclusively for the stated purposes of this journal and will not be made available for any other purpose or to any other party. However, for the purpose of academic transparency, the corresponding author’s contact email will be published alongside the article.
